The separation agreement is the final document outlining the terms of a legal separation. This agreement must include instructions for the division of marital property, the allocation of responsibility for marital debts and spousal maintenance terms. In many cases, legal separation requires special rules regarding financial conduct, such as standards for new debts or arrangements for who lives in the marital home.
If you have minor children, your separation agreement must also address the division of child custody and parenting time, as well as child support. Spouses must essentially address all of the same issues they would in a divorce.
Can Legal Separation Evolve Into A Divorce?
Yes. A legal separation can be converted into a divorce in Minnesota, whether you make that choice during the separation process or after the court issues a Decree of Legal Separation. Either spouse may request the change, and the case then shifts from a separation action to a divorce action.
The court does not start over; instead, it uses the existing filings and updates the case to address divorce‑specific issues. A judge must review the request, ensure all statutory requirements are met and sign the final Judgment and Decree to make the divorce legally binding.
